Terms of Use – Virtual Try-On Application (Virtual Try-On)
1. Introduction and Agreement to the Terms
1.1 These terms regulate the use of the Seven Seventy website and application (hereinafter: "the Application" or "the Service") operated by TRY FIT (hereinafter: "the Company").
The Application allows the user to select a clothing item, upload a picture of themselves, and receive a visual simulation of the clothing item on their body (hereinafter: "the Simulation").
1.2 Use of the Application constitutes full agreement by the user to all terms of these regulations.
1.3 If you do not agree to the terms of these regulations – you must refrain from using the Application.
1.4 These regulations are written in the masculine form for convenience only and refer to all genders.
 
2. Definitions
For the purpose of these regulations:
"User" - any person using the Application.
"User Content" - any image, information, or content uploaded to the Application by the user.
"The Image" - an image uploaded by the user for the purpose of creating a simulation.
"The Simulation" - an image created using the Application, combining a clothing item on the user's body.
"AI Technology" - artificial intelligence systems used for image processing and simulation creation.
 
3. Nature of the Service
3.1 The Application allows for the creation of a visual simulation of clothing on the user's image.
3.2 The simulation is created using automated means, including artificial intelligence systems.
3.3 The simulation is intended for illustration purposes only and does not constitute a commitment to an exact match between the simulation and the actual appearance of the garment.
3.4 There may be differences between the simulation and the actual reality due to various factors, including:
● Quality of the image uploaded by the user
● Shooting angle and body posture
● Lighting and background
● Actual garment characteristics
● Technological limitations of AI systems
3.5 The user declares that they are aware that results obtained through AI systems are not necessarily accurate or perfect.
 
4. Terms of Use
4.1 Use of the Application is permitted only for users aged 18 and over.
4.2 The user undertakes that:
● The image uploaded is their own or they have legal permission to use it
● Uploading the image does not infringe on the rights of any third party
● The image does not include illegal content
4.3 It is forbidden to upload:
● Images of another person without their consent
● Images that infringe on privacy
● Nudity or sexual content
● Images including minors without parental consent
● Offensive, incitement, or illegal content
4.4 The Company may remove content, restrict use, or block a user in case of a violation of these terms.
 
5. License to Use User Content 
5.1 The user declares that they own the rights to the uploaded image or have obtained legal permission to use it.
5.2 Upon uploading the image, the user grants the Company a limited, non-exclusive, and royalty-free license to:
● Process the image using technological means
● Create the requested simulation
● Display the simulation to the user
5.3 This license is granted solely for the purpose of operating the Service.
5.4 The license will expire upon deletion of the image from the Company's systems in accordance with the data retention policy.
 
6. Processing using AI Technology
6.1 The creation of the simulation is done using image processing and artificial intelligence systems.
6.2 It is possible that the images will be processed by external technology providers who provide AI processing services for the Company.
6.3 The Company will not use user images for:
● Facial recognition
● Creation of a biometric database
● Advertising or selling information
Unless explicit consent has been given.
 
7. Misuse of the Service
7.1 The user undertakes not to use the Application for:
● Creating misleading or impersonating simulations
● Infringing on another person's privacy
● Creating offensive or illegal content
7.2 It is forbidden to use the service to create Deepfakes or simulations that may harm another person.
 
8. Abuse Detection
8.1 The Company may activate automatic mechanisms for detecting misuse.
8.2 The Company may limit or block access to the service in case of unreasonable use or suspicion of harmful activity.
 
9. Rate Limiting
9.1 The Company may limit the number of operations that can be performed in the Application within a given time frame.
9.2 These limitations are designed to protect the availability and integrity of the Service.
 
10. Service Availability
10.1 The Company does not guarantee that the Service will be available at all times or without interruptions.
10.2 The Service may be temporarily shut down for maintenance, updates, or upgrades.
 
11. Beta Features
11.1 The Company may offer experimental features or beta versions.
11.2 These features may be unstable or inaccurate.
11.3 Use of experimental features is at the user's own risk.
 
12. Data Retention and Deletion
12.1 The Company will endeavor to delete images and simulations from the active production environment within a reasonable time after the completion of the Service.
12.2 Certain data may be retained for a limited period for:
● Technical operation
● Information security
● Prevention of misuse
12.3 Deletion from backup systems and caches will be carried out in accordance with accepted technological deletion cycles.
 
13. Privacy and Information Security
13.1 The Company takes reasonable measures to protect user information.
13.2 The information will be processed in accordance with applicable Israeli law.
 
14. Intellectual Property
14.1 All intellectual property rights in the Application, technology, and design belong to the Company or to third parties who have granted it a license to use.
14.2 The user may use the simulation for personal purposes only.
14.3 It is forbidden to perform:
● Reverse engineering
● Copying the technology
● Commercial use without the Company's permission
 
15. Indemnification
The user undertakes to indemnify the Company, its employees, and its representatives for any damage, claim, or demand arising from a violation of these terms or from the uploading of illegal content.
 
16. Limitation of Liability
16.1 The Application is provided "AS IS".
16.2 The Company does not guarantee that the Service will be free of errors or interruptions.
16.3 The Company will not be liable for indirect, consequential damages, or loss of data arising from the use of the Service.
16.4 Nothing in these terms shall derogate from liability that cannot be limited by law.
 
17. Liability Cap
In any case, if the Company is obligated to compensate, its total liability shall not exceed the amount of ILS 500 or the amount actually paid for the use of the Service – whichever is higher.
 
18. Termination of Service 
The Company may change, suspend, or terminate the Service at any time.
 
19. Changes to the Terms 
The Company may update these terms from time to time. Continued use of the Application after the update constitutes agreement to the updated terms.
 
20. Governing Law and Jurisdiction
20.1 These terms shall be governed solely by the laws of the State of Israel.
20.2 The exclusive jurisdiction for any dispute regarding the use of the Application shall be given to the competent courts in Tel Aviv-Yafo only.
